This website has been authorized by the Palm Beach County MS4 NPDES (PBC NPDES) Steering Committee as a resource for all permittees within the county. It is intended that this site will provide the permittee with helpful information on understanding and complying with the requirements of the MS4 NPDES permit.
 
   
 

Permit Component - Construction Site Runoff

The 3rd Cycle permit continues to include requirements related to preventing and/or reducing pollutants in stormwater runoff from construction sites.

Please note: the MS4 permit is not the same as the FDEP Generic Permit for Stormwater Discharge from Large and Small Construction Sites (GCP).

The PBC MS4 NPDES permit requires that permittees to the following related to construction site runoff include:

  • Implement local ordinances/codes requiring construction site planning approval and the use of structural and non-structural controls to prevent pollutants in construction site runoff
  • maintain written procedures for conducting pre-construction site plan reviews.
  • conduct site inspections of construction sites for proper stormwater, erosion and sedimentation BMPs. Use a formalized inspection checklist for the inspections and maintain an inspection log of all inspections conducted. All inspectors of construction sites shall be certified through the Florida Stormwater, Erosion, and Sedimentation Control Inspector Training Program and follow-up training shall be provided annually.
  • carry out enforcement using notices of violation and/or stop work orders for those construction site operators which repeatedly fail to comply with approved erosion and sediment control BMPs
  • provide annual stormwater erosion and sediment control training for construction site plan reviewers, site inspectors, site operators, and private persons. NOTE: The annual stormwater erosion and sediment control training program for construction plan reviewers, site inspectors, site operators and private persons is completed as a joint activity by the permittees. Documentation of the training program for annual reporting purposes will be made available at the end of each reporting year.

FDEP Generic Construction Permit

Any construction site (publically or privately owned) that disturbs one acre or more of land, is required to seek coverage under the FDEP Generic Permit for Stormwater Discharge from Large and Small Construction Activities (CGP).

It is the CGP that includes the requirement that a Notice of Intent (NOI) and Notice of Termination (NOT) be submitted to FDEP. It is also the CGP that requires completion of a stormwater pollution prevention plan (SWPPP). Visit FDEP's webpage related to construction activity.
